Divorce Attorney| Family Law Attorney

Pursuant to Georgia Law, there are thirteen (13) grounds upon which a complaint for divorce may be brought by one spouse against the other. The most common ground for divorce involves a situation upon which there exists "irreconcilable differences" between the parties, and as a result the marriage is considered to be "irretrievably broken."

Divorce can be Uncontested, in which the parties agree on the distribution of assets, debts, child support, visitation and child custody. Divorce can also be Contested, in which the parties do not agree on the distribution of assets, debts, visitation, child support or child custody, and a Judge has to make an equitable distribution of assets and make a decision on child custody, visitation and support that is in the best interest of the child(ren).

The Clarke Law Office, LLC provides knowledgeable legal advice and offers effective help in these often distressing personal situations. Our firm strives to reach a just and fair agreement between our client and their spouse. If an acceptable agreement cannot be reached, we vigorously pursue and protect your rights in court.

In Divorce and Divorce-related cases, people are under a great deal of stress. One of the goals of the Attorney-Client relationship is for clients to be able to leave the problem, regardless of what it is, with the attorney, so that the client will be relieved of the stress created by the problem.

I represent the client's best interest by being a "problem solver." I take the burden away from the client and address the problem directly, while keeping the client informed. In addition, I am careful to review any other legal needs required by the client to provide "full service" for someone going through a divorce, including Wills, trusts, Powers of Attorneys, Medical Powers of Attorneys, and Living Wills.

The Clarke Law Office, LLC, practices in the following areas:

o Divorce
o Child Support
o Custody
o Visitation
o Adoption
o Guardianship
o Legitimation

What Is An Uncontested Divorce?

An uncontested divorce occurs when: (a) there are no disagreements between you and your spouse over any financial or divorce-related issues (i.e., child custody and support, division of marital property or spousal support); and (b) your spouse either agrees to the divorce, or fails to appear in the divorce action.

INFORMATION
Usually, the start of a new business entails the filing of proper paper work with the State and the IRS and timing is essential. The process begins with selecting the type of business entity you wish to conduct business under such as a sole proprietor, partnerships, corporations, or limited liability company.

A sole proprietor is a stand alone person who is in complete control of their business and are personally liable for any liabilities that occurs in operating their business. A partnership consists of two or more persons in agreement to operate a business. This form of business can be established by written agreement or an informal agreement and each partner is usually responsible for the liabilities that occur in operation of the Partnership. However, the partnership differs from a sole proprietorship in that the partnership is actually considered a separate entity. For tax purposes, both types of entities owners are personally responsible for the taxes of the entities.

However, there exist several different types of partnerships that are general partnership, limited partnership, and limited liability partnership. Generally, in a limited liability partnership the partners are afforded the protection of limited liability. In essence, it affords them the same protection as a corporation.

A Corporation is a separate entity that is incorporated with a state and consists of shareholders that adhere to the articles of incorporation, shareholder agreement or bylaws. If properly operated, a corporation may have a special protection of limited liability. For tax purposes, most corporations have to pay two taxes. Thus, this sometimes makes it unpopular with small business owners. However, with an S-Corporation it affords the protection of a regular corporation but the shareholders are taxed personally and it is has certain restrictions. Next, the newest entity type is known as a limited liability company which is somewhat of a hybrid of a corporation and a partnership. It is afforded the protection of a corporation and the ease of operations like a partnership. Further, it may be taxed as a sole proprietor, a partnership, or a corporation .

INFORMATION

Currently, the career of an entertainer or athlete is often 2 years or less. Thus, during the beginning of their career the entertainer or athlete needs to make sure they secure enough money, equity, and future financial security to survive for the rest of their life. This is why it is important to have an attorney negotiate on your behalf and to guide you in your important financial decisions. The common mistake new entertainers make is signing a contract for an agreed amount of money without representation. This often results in later expensive legal bills, and spending more money to acquire the rights you signed away in your contract. An attorney can negotiate contracts, furnish advice on business and tax matters, seek endorsement, estate planning, legal consultations, and assist with off-season employment.
